1. By entering the Promotion, entrants agree to be bound by these terms and conditions (the “Terms”).

2. The promoter is Robert Bosch Limited, a company registered in Scotland with company number SCO13418 whose registered office address is at C/O Bosch Rexroth, Viewfield Industrial Estate, Glenrothes KY6 2RD, United Kingdom (“Promoter”). C3 Creative Code and Content GmbH at Rotebühlstrasse 81, 70178 Stuttgart (“C3”) have been appointed to assist the Promoter with managing and administering this Promotion. Therefore, C3 will be performing some of the obligations stated in these Terms on behalf of the Promoter.

3. The Promotion will commence on 30 October 2024 at 06:00 pm (GMT). The closing date for receipt of Entries is 10 November 2024 at 23:59pm (GMT) (“Closing Date”). The Promotion is free to enter and no purchase is necessary.

4. The Promotion is open to individuals aged 18 or over and resident in the United Kingdom and the Republic of Ireland (“Eligible Participant”). Employees of the Promoter, or of any other company within the Bosch group of companies (including BSH Home Appliances Limited), and their immediate family members, Bosch’s agents or their employees, or any person professionally associated with this Promotion (or members of their family or household) may not participate in the Promotion.

5. The Promoter assumes that by entering the Promotion (and you warrant that) you are aged 18 or over. Participants entering the Promotion as an employee of an organisation have an obligation to (i) inform their employer about the Promotion, and (ii) obtain the permission of their employer to enter the Promotion.

Entry (“Entry”):

6. An Eligible Participant will be automatically entered into the Promotion if they:  

1. Follow the Bosch DIY and Garden Facebook page @boschdiyandgarden; and
2. Like the post; and
3. Share the story of their proudest DIY hero project in the comments section of the Paramount UK and Bosch DIY and Garden Transformers Prize Draw 2024 photo post on Facebook (“Prize Draw Post”).

7. Up to one (1) Entry can be made per Eligible Participant. Entries received after the Closing Date will not be accepted.

8. The Entry must be made via Facebook in English. Any Entry that does not contain the information required above or comply with all requirements will be an invalid Entry and will not be entered into the Promotion. The Promoter reserves the right and has complete discretion to disqualify any Entry deemed unsuitable, inappropriate, explicit or offensive, and accepts no responsibility for Entries not successfully or fully completed due to any reason including technical faults.

9. All valid and correct Entries will be entered into the prize draw for a chance to win a prize. The prize-winners will be chosen at random from all qualifying Entries within seven (7) days of the Closing Date (the “Winner(s)”).

Runner Up Prizes (“Runner Up Prizes”):

The prize shall be fifteen (15) merchandise bundles each featuring Picture-related merchandise including:

                The First Prize and the Runner Up Prizes together shall be the (“Prizes”).

11.  The additional terms and conditions for the First Prize are set out in Annex 2.

12. There will be one (1) First Prize and fifteen (15) Runner Up Prizes in total that will be awarded to sixteen (16) individual Eligible Participants. Each Eligible Participant

cannot win more than one Prize.

13. The Prizes are not transferable and there is no cash alternative. The Promoter, at its own discretion, reserves the right to substitute the Prizes with product(s) of equal or greater value at any time.

14. The Prizes or any promotional item(s) must not be auctioned or resold. The Promoter reserves the right to refuse to accept further entries under this Promotion or any other promotion if it becomes aware of the reselling or auctioning of the Prizes or any promotional item(s).

15. The Winners give their consent to be notified by private Facebook message from the Promoter within ten (10) days of the Winners being identified (“Notification”).

16. For the First Prize only, the Notification will ask for the Winner’s email address. The Promoter shall then email the Winner, confirming:

(i) that they are the Winner of the First Prize;

(ii) the details of the First Prize; and

(iii) the contact details of Octopi for the Winner to contact and accept the First Prize.

Octopi will administer the prize acceptance agreement (“Prize Acceptance Pack”). The First Prize is conditional upon the Winner and each of their guests signing (or having signed on their behalf where they are children) a binding participant prize acceptance agreement in the form set out in the Prize Acceptance Pack.

17. For the Runner Up Prizes, the Notification will ask for the Winner’s delivery address in the United Kingdom or the Republic of Ireland. The Winners must contact the Promoter within 14 days of the date of Notification to claim their Runner Up Prize (“Winner Confirmation”). If a Winner fails to claim their Runner Up Prize, such Winner will forfeit the Runner Up Prize and another valid Entry will be drawn. The Promoter will arrange for the Runner Up Prizes to be delivered to each Winner’s address in the United Kingdom or the Republic of Ireland at its cost. Please allow up to 28 days from the Winner Confirmation for delivery of the Runner Up Prizes.

18. The Promoter cannot accept responsibility for delayed or incorrectly submitted entries, or entries which are not submitted via Facebook.

General:

19. In all matters relating to the Promotion, the decision of the Promoter shall be final and no correspondence or discussion shall be entered into.

20. At all times throughout the Promotion, participants must deal with the Promoter in the utmost good faith in every respect. The Promoter reserves the right to verify the eligibility of all participants and disqualify any participant that it has reasonable grounds to believe has breached any of the Terms, including, but not limited to, falsifying any information submitted to or requested by the Promoter.

21. The Promoter reserves the right to amend or terminate the Promotion at any time without notice. However, the Promoter will use its reasonable endeavours to minimise the effect of such amendment or termination to avoid disappointment. Any termination or amendment to the Promotion will be communicated to you in the same way as the Promotion was communicated.

22. The Promoter excludes all liability for taxes relating to the First Prize and the Runner Up Prizes and any tax liability arising from the provision of the First Prize and the Runner Up Prizes will be the sole responsibility of the recipient of the First Prize and/or the Runner Up Prizes.

23. The Winners agree that, except for any support to be provided by the Prize Package Provider as expressly set out in the these Terms and Conditions, neither Paramount, Hasbro Inc., the Promotor nor the Prize Package Provider, nor any of their officers, directors, employees, agents, representatives, successors or assigns (collectively, the “Released Parties”) shall be responsible for providing any advice or support of any kind in connection with the First Prize and the Runner Up Prizes (including but not limited to financial, logistical or other support or an alternative or substitute prize).

24. To the maximum extent permitted by applicable law, the Winners shall not bring any claim or action against, or make any demands of, any Released Party in respect of any loss, damage or liability of any kind that they or members of their party benefiting from the Prizes or accompanying them may suffer, whether now known or unknown, foreseen or unforeseen, arising out of or in connection with the acceptance, use or misuse of the Prizes and their participation in any Prize related activity (including without limitation losses for personal injury, contracting a disease, damages and losses to personal property and/or any additional costs they may incur or consequences that they may suffer due to travel cancellation, interruption, changed flights, extended stays, medical treatment, hospital stays, quarantine or isolation, and travel restrictions, or otherwise).

25. The Promoter does not claim any rights of ownership in the Entry, nor does the Promoter accept responsibility for the return of any Entry, including those consisting of artistic or other material.

26. To the extent permitted by law, the Winner’s name (surname and county) can be obtained by sending a stamped addressed envelope to: the attention of Bosch Power Tools marketing department Robert Bosch Limited, C/O Bosch Rexroth, Viewfield Industrial Estate, Glenrothes, KY6 2RD. If a Winner objects to this, they may notify the Promoter of their objection. In such circumstances, the Promoter must still provide the information and winning entry to the applicable advertising authority upon request.

27. The Promotion is not affiliated with Facebook and is in no way connected with, sponsored, endorsed or administered or otherwise associated, supported, accompanied or monitored by Facebook or any subsidiary companies and/or associates. All questions, comments or complaints relating to the Promotion should be addressed to the Promoter and not to Facebook. Participant agrees that Facebook is not liable or responsible for this Promotion and therefore the participant releases Facebook from any liability or responsibility in relation to this Promotion.
28. If a participant does not wish for their details to be entered into the Promotion or if the participant opts out but then wishes to re-enter, the participant can advise the Promoter by writing to its address set out in clause 2, or by email to the email as stated in the data protection notice in Annex 1.

29. The Promoter will process the Eligible Participant’s personal data (such as name, address and email address) which they provide to the Promoter for the purposes of the Promotion; in order to administer the Promotion and to deliver the Prizes. We may also involve external service providers who manage and administer this Promotion on our behalf. To find out more about this and about how the Promoter handles each Eligible Participant’s personal information in accordance with the law, this can be found at the Privacy Policy as stated in Annex 1 to these Terms.

Moreover, you may be asked to provide certain personal data to Paramount in relation to access to the Universal Studios site and other elements of the First Prize. 30. The Promotion will be governed by the laws of England and Wales and the courts of England and Wales shall have the exclusive jurisdiction to settle any dispute or claim arising out of or in connection with the Promotion.

4.   Collection, processing and usage of personal data

4.1 Processed categories of data

The following categories of data are processed:

•             Communication data (e.g. name, telephone, e-mail, address)

•             Miscellaneous: any personal data you provide in the entry to the Prize Draw (such as Facebook username and picture).  In addition, if you are the Winner of the First Prize, you agree to provide certain additional personal data for the purpose of prize fulfilment to other data controllers as stated in section 1 of this data protection notice.

4.2 Principles

Personal data consists of all information related to an identified or identifiable natural person, this includes, e.g. names, addresses, email addresses, contractual master data, contract accounting and payment data, which is an expression of a person's identity.

We collect, process and use personal data only when there is either a statutory legal basis to do so or if you have given your consent to the processing or use of personal data concerning this matter, e.g. by means of registration.

4.3 Processing purposes and legal basis

We, as well as the service providers commissioned by us, process your personal data for the following processing purposes:

4.3.1. Receiving entries for the Prize draw, conducting the Prize draw and notification and delivery of prizes from the Prize Draw as outlined in our Terms.

(Legal basis: fulfilment of the contractual obligations as described in the Prize Draw Terms as well as our legitimate business interests in connection with the Prize Draw and supply of the First Prize and/or Runner Up Prizes.). In addition, if you are the Winner of the First Prize, you agree to provide certain additional personal data for the purpose of prize fulfilment to other data controllers as stated in section 1 of this data protection notice.

4.4 Children

The Prize Draw is not meant for children under 18 years of age.

4.5 Data transfer to other controllers

Principally, your personal data is forwarded to other controllers only if required for the fulfilment of a contractual obligation, or if we ourselves, or a third party, have a legitimate interest in the data transfer, or if you have given your consent. Particulars on the legal basis and the recipients or categories of recipients can be found in the Section 4.3 Processing purposes and legal basis. Third parties may also be other companies in the Bosch group. In addition, if you are the Winner of the First Prize, you agree to provide certain additional personal data for the purpose of prize fulfilment to other data controllers as stated in section 1 of this data protection notice.

For announcement of your parcels of the Runner Up Prizes, we may transfer your email address within the scope of the fulfilment of the contractual obligations to the following:

DPDGROUP UK LTD, Roebuck Lane, Smethwick, West Midlands, B66 1BY (or other companies within DPD Group). This company may process data as a data controller.

Additionally, data may be transferred to other controllers when we are obliged to do so due to statutory regulations or enforceable administrative or judicial orders.

4.6 Service providers (general)

We may involve external service providers with tasks such as administration and organisation of the Prize Draw, procurement, parcel collection and delivery. We have chosen those service providers carefully and monitor them on a regular basis, especially regarding their diligent handling of and protection of the data that they store. We only transmit your data to external service providers where necessary to fulfil a contract with you, where we or the recipient has a legitimate interest in the disclosure of your data, or where you have given your consent to that transmission. We involve external service providers including C3 and Octopi with tasks such as contract management (including validating Entries, selecting random Winner(s) and delivering the First Prize and/or the Runner Up Prizes) for the Prize Draw. All service providers are obliged to maintain confidentiality and to comply with the statutory provisions. Service providers may also be other Bosch group companies.

4.7 Transfer to recipients outside the UK and EEA

We might transfer personal data to recipients located outside the UK and EEA into so-called third countries. In such cases, prior to the transfer we ensure that either the data recipient provides an appropriate level of data protection or that you have consented to the transfer.

You are entitled to receive an overview of third country recipients and a copy of the specifically agreed provisions securing an appropriate level of data protection.  For this purpose, please use the contact details in section 3 of this Annex 1.

4.7 Duration of storage, retention periods

Principally, we store your data for as long as it is necessary for us to fulfil the contract or for as long as we have a legitimate interest in storing the data. In all other cases we delete your personal data with the exception of data we are obliged to store for the fulfilment of legal obligations (e.g. due to retention periods under the tax and commercial codes we are obliged to have documents such as contracts and invoices available for a certain period of time).Your information will be deleted once it is no longer required to run the Prize Draw or once it is no longer necessary to complete any follow-ups with Winners .

5. Security

Our employees and the companies providing services on our behalf, are obliged to confidentiality and to compliance with the applicable data protection laws. We take all necessary technical and organizational measures to ensure an appropriate level of security and to protect your data that are administrated by us especially from the risks of unintended or unlawful destruction, manipulation, loss, change or unauthorized disclosure or unauthorized access. Our security measures are, pursuant to technological progress, constantly being improved.

6. User rights

To enforce your rights, please use the details provided in section 3 of this Annex 1. In doing so, please ensure that an unambiguous identification of your person is possible.

Right to information and access

You have the right to obtain confirmation from us about whether or not your personal data is being processed, and, if this is the case, access to your personal data.

Right to correction and deletion 

You have the right to obtain the rectification of inaccurate personal data.  As far as statutory requirements are fulfilled, you have the right to obtain the completion or deletion of your data. 

This does not apply to data which is necessary for billing or accounting purposes or which is subject to a statutory retention period. If access to such data is not required, however, its processing is restricted (see the following).

Restriction of processing

As far as statutory requirements are fulfilled you have the right to demand for restriction of the processing of your data.

Data portability

As far as statutory requirements are fulfilled you may request to receive data that you have provided to us in a structured, commonly used and machine-readable format or – if technically feasible – that we transfer those data to a third party.

Object to direct marketing

Additionally, you may object to the processing of your personal data for direct marketing purposes at any time. Please take into account that due to the organizational reasons, there might be an overlap between your objection and the use of your data within the scope of a campaign that is already running.

Objection to data processing based on the legal basis of “legitimate interest”

In addition, you have the right to object to the processing of your personal data at anytime, insofar as this is based on legitimate interest. We will then terminate the processing of your data unless we demonstrate compelling legitimate grounds according to legal requirements which override your rights.

Withdrawal of your consent

In case you consented to the processing of your data, you have the right to revoke this consent at any time with effect for the future. The lawfulness of data processing prior to your withdrawal remains unchanged.

1. The Prize

There will be one (1) prize consisting of a trip to Los Angeles, USA for up to two (2) adults aged eighteen (18) or over and two (2) persons aged seventeen (17) or under who must be accompanied by a parent or legal guardian (i.e., the winner and one (1) additional adult and two (2) persons aged seventeen (17) or under) (collectively, the “Recipients”)  which consists of the following (the “Prize”):

1. round trip economy flights (inclusive of all all airport taxes, fees and /or duties) for the Recipients from London or Dublin to Los Angeles, USA;
2. Private round-trip ground transportation for the Recipients to and from the Los Angeles airport, to and from Universal Studios Hollywood (“Universal Studios”), and to and from the Paramount Pictures Studio Tour;
3. hotel accommodations consist of a four (4) night stay in a four (4) star Los Angeles hotel in a family room, including breakfast. All Recipients to be lodged in a single room.
4. Subject to each Recipient completing any applicable liability waiver forms required by the activity providers of the activities below and any other documents as requested by Octopi Promotions Limited (“Travel Agency”) prior to the activities, and subject to any relevant age, height or weight restrictions, Recipients will participate in the following activities which will be held in English:

(a)_One day VIP tickets to Universal Studios Hollywood, including 1-Day              Park admission to Universal Studios Hollywood, a VIP Guide to tour locations closed to the general public, unlimited express access to each ride, attraction and seated show, a gourmet meal and light refreshments served in a VIP lounge; and

(b) One Paramount Pictures Studio Tour lasting two (2) hours.

2. Prize Conditions

1. The Recipients must travel at the same time with the same itinerary;
2. Recipients must travel between 1 November 2024 and 30 November 2025. Travel is not permitted in July or August and between 15 December 2024 and 15 January 2025, and 10 – 30 April 2025;
3. Recipients must provide the Travel Agent with at least ninety (90) days’ advance notice of travel date preferences and each Recipient must provide a copy of their passport to the Travel Agent in order to book the Prize;
4. once the Travel Agent has received signed booking forms, no changes will be permitted;
5. the Travel Agent will endeavour to accommodate the travel date preferences specified by the Recipients of the Prize, but all travel is subject to availability. Flights may be indirect and no stopovers or extensions to the trip are permitted. Recipients are responsible for travel to the airport in their home country. Activities referenced in section 1(iv) herein are subject to availability at the time of booking and alternatives of equal or greater value may be offered, dependent on availability;
6. Recipients must observe at all times the Covid-19 restrictions and health and safety laws and regulations applicable to travel, hotel and activities. This may include, but not be limited to, testing requirements and/or proof of vaccination status. The Recipients shall be responsible for ensuring that they comply at all times with any such restrictions and/or requirements in order to redeem the prize.
7. Recipients must be willing and able to meet all USA entry and exit requirements, including COVID-19 related requirements, if applicable. Recipients are responsible for the cost of any COVID-19 tests and/ or related certifications that may be required and the cost of any COVID-19 related restrictions including any quarantine restrictions upon return to their country of residence;
8. accommodations for the Recipients includes breakfast. Any other meals, incidentals, gratuities, telephone calls or personal expenses not expressly included in the Prize and incurred during the trip will be the responsibility of the Recipients. A credit card for incidentals may be requested by the hotel at check-in and therefore at least one of the Recipients must possess and travel with a valid credit card;
9. the Prize is non-transferrable, non-changeable and non-refundable. Recipients cannot change, vary, substitute or extend any element of the Prize (in whole or in part). If Recipients are unable to take the Prize during the stated time period Recipients will forfeit the Prize with no compensation. Cash will not be awarded in lieu of the Prize;
10. if required, the Recipients must organise their own visas for travel to Los Angeles, USA and any transit countries. Travel Agent shall assist in the translation of visa application documents and certification of the travel itinerary where required. Any visa or passport charges are the responsibility of the Recipients. The Travel Agent and the promoter will not be responsible for the Recipients being unable to participate in the Prize due to visa or passport restrictions and no refunds or alternatives will be provided;
11. The Travel Agent shall assist with booking and pay for the cost of adequate travel insurance suitable for the needs of the Recipients if they are aged 64 or younger. The Travel Agent will provide a contribution towards the cost of travel insurance of £50 GBP per person for Recipients aged sixty-five (65) or older and/or those with pre-existing medical conditions for which the Travel Agent is unable to procure travel insurance coverage. In such a case the Recipient must organise their own suitable travel insurance cover and send the Travel Agent a copy of their travel insurance documents before they travel;
12. Anything not specified in these terms and conditions as being included in the prize package is excluded. In particular (but without limitation) the prize does not include expenses, spending monies, meals other than as stated, the cost of travel to the airport in the Recipients home country, and transfers other than those stated;
13. Recipients travel at their own risk and, if for any reason any aspect of the Prize is not capable of running as planned, including war, terrorism, state of emergency, pandemic, or any other kind of disaster, tampering or computer virus, the Travel Agent reserves the right to substitute or modify the Prize, subject to any written directions from a relevant regulatory authority.
